In this regard, the contracting party to which the offer is submitted or proposed consents to mutual consideration, the offer being deemed accepted, resulting in a commitment. An agreement is an agreement between two or more parties. A contract is a particular type of agreement which, by its terms and elements, is legally binding and enforceable in court. There are two types of misrepresentations: fraud in fact and fraud in incitement.
